Sri Pranab Kumar Bhattacharjee & Ors.

None appears on behalf of appellant. Same

situation prevailed on 1st July, 2021, when following

order was made.

"The second appeal tender is of year 2001. Additional Stamp Reporter has reported erroneous date of judgment recorded in certified copy of decree of lower appellate Court. None appears on behalf of appellant.

Let notice be issued to the learned advocate enclosing copy of this order. In event steps are not taken to remove the defect or appellant continues to go unrepresented on adjourned date or thereafter or either of the above, the appeal is likely to be dismissed.

List in monthly list of August, 2021. Additional Stamp Reporter will report on removal of defect or omission in regard thereto, as the case may be."

Noting dated 26th July, 2021 says notice was

issued. Printed list has been published. Since the

defect can be dealt with after the appeal is moved for

admission and in view of above, we are convinced

appellant has lost interest.

S.A.T. 819 of 2001 is dismissed.
