              PER COURT :

1. Vide order dated 18.03.2024 passed by this Court, the parties to

the present appeal were referred to the mediator. Accordingly Mr. S. D.

Hiwrekar, the mediator conducted mediation between the parties and

submitted successful mediation report dated 03.04.2024 which is

received by this Court. It is taken on record and marked as 'Exhibit X'

for identification.

2. As per the mediation report, the dispute between the parties

amicably settled on certain terms and conditions which have been

prescribed in settlement deed which is part and parcel of mediation

report 'Exhibit X'.

3. Needless to say that in pursuance of Judgment and decree dated

03.05.2007 passed by the learned District Judge-1, Amalner in Civil

Appeal No. 54/2015 the original defendant already executed sale-deed

in favour of the plaintiff on 22.04.2024. It further appeared that the

defendant agreed to execute sale-deed by accepting additional amount

of Rs. 10,00,000/- in addition to Rs. 21,00,000/- and the plaintiff will

have no objection to withdraw an amount of Rs. 15,75,000/- along with

interest, if any, accrued thereon which has been deposited by plaintiff.

4. In view of terms and conditions of settlement deed in mediation

report 'Exhibit-X', Second Appeal is disposed off. Decree be drawn up

accordingly.

5. No order as to costs.

6. Civil Application is disposed off.
