1. By consent, the impugned judgment and order dated 20 th

September, 2016 passed by the Commissioner, Workmen's

Compensation, Beed in W.M.C. No. 25/2013 is hereby set aside. The

proceedings are remitted back to the Commissioner for decision

afresh in accordance with law. Points raised by rival parties are kept

open.

2. Since the original proceeding is of the year 2013, the

Commissioner to decide the same within a period of six months from

1st February, 2024. Amount deposited by appellant is permitted to be

withdrawn along with accrued interest, if any. Parties are directed to
