1. Heard the learned counsel for the appellants.

2. The claim of the present appellants based upon the

"HIBA" was decreed by the learned Trial Court. However, the

learned First Appellate Court reversed the same.

3. In view of the issue involved in the case, issue notice to

the respondent before admission.

4. Meantime, the execution and implementation of the

impugned judgment and decree of the Appellate Court stands

stayed till the appearance of the respondent.

5. The appellants shall take steps to serve the respondent at

the earliest.

7. In addition to the routine mode of service, leave granted
