Heard Mr. Jagdale, learned counsel for the petitioner.

2. It is contended, that though the plea that the show cause notice was not issued by the Competent Authority and the enquiry officer acted as a prosecutor, was raised the plea has not been considered by the learned Industrial Court. A perusal of the judgment of the learned Industrial Court dated 07.10.2023 prima facie indicates it to be so, though a ground has been raised in that regard having raised before the learned Labour Court.

3. Issue notice for final disposal to the respondents, returnable in four weeks.

4. The petitioner to serve the respondents by all 2 6.WP.7020-2023.odt

modes permissible in law.

5. The order dated 07.10.2023 passed by the learned Industrial Court shall be continued for a period of four weeks.
