We have heard Mr. Gupte, learned senior counsel appearing for
the applicant. Drawing support from the judgment of Apex Court in
the matter of Divine Retreat Centre V/s. State of Kerala and ors.
Reported in (2008) 3 SCC 542, we are informed that since the relief

sought in the petition is affecting the rights of the applicant, he is
necessary party to the petition.
2. In response of above, learned counsel for the original petitioner/
complainant submits that the reply is already placed on record
objecting such prayer.
