2 The Petitioners in both the Petitions are existing Presidents/Members of District Consumer Commissions in the State of Maharashtra. They are seeking relief inter alia to continue their tenure till the recommendation of regular selection committee is made.

3. The Coordinate Bench of this Court(Nagpur) has considered similar issues and had passed an order protecting the services of the

Petitioners therein till the appropriate recommendation is made by the selection committee. The said Judgment of the Coordinate bench has been following by the Single Judge of this Court (Aurangabad Bench) in Writ Petition No. 5300 of 2023 and connected petition.

4. Therefore, for the reasons stated in the order dated 3rd May, 2023 in Writ Petition No. 2496 of 2023 and Writ Petition No. 5300 of 2023, the Petitioners have made out a case for grant of ad-interim relief in terms of prayer clause (d). However, it is made clear that in case, the selection committee does not recommend the name of the Petitioners in both the Petitions, they will have no right to continue on the post.

5. Issue notice to respondents, returnable on 26th June, 2023.

6. Learned AGP waives service of notice on behalf of the Respondent No. 2.
