PER COURT:-
1. The settlement terms have been taken on record and
marked as Annexure 'A'. The parties have settled the dispute amicably.
The demand draft has been handed over to the learned counsel for
the petitioner.
2. The respondent was held guilty for the offence
punishable under Section 138 of Negotiable Instruments Act. The
offence is compoundable. The parties have settled the dispute
amicably. Hence, the following order :
ORDER
I) The judgment and order of the learned Judicial Magistrate First
Class, Jalgaon in SCC No.384 of 1997 dated 21.06.2004 is set aside.
II) The respondent/accused is acquitted for the offence punishable
under Section 138 of Negotiable Instruments Act.

III) The fine amount, if deposited by the accused be returned to
him.
IV) The revision application stands disposed of in the above terms.
