1. This is an interim application for condonation of delay of 12 years

and 240 days in preferring the appeal on behalf of the claimants for

enhancement of the compensation on the point of future prospects against

the judgment and order dated 6 May 2009 passed by the MACT, Thane in

MAC No. 405 of 2003.

2. Learned Counsel for the interim Applicant would submit that first

appeal no. 596 of 2011 filed by the MSRTC,Respondents in this appeal,

has already been admitted and therefore, the delay be condoned.

3. Learned Counsel draws the attention of this Court to paragraphs no.

2 to 9 of the application in support of her contention.

4. On the other hand Ms. Punjabi,learned Counsel for the Respondent-

Corporation opposes the application and submits that her senior will

argue the matter after the appeal filed by the Corporation is listed along

with the interim application.

5. Be that as it may, let the Respondent-Corporation take instructions

in the matter and or file reply by the next date. It is made clear that if

no instructions are taken or no reply is filed by the next date, this Court

will proceed to pass appropriate orders in this application.

6. List on 28 June 2023 with First Appeal No. 596 of 2011.
