The petitioners seek to raise a challenge to the order passed by the Central Administrative Tribunal on 23.10.2008 in proceedings that were filed by the respondent no.1. By the said order the Tribunal held the respondent no.1 entitled to the benefit of family pension. According to the petitioners the Civil Court has held the petitioners entitled to grant of succession certificate by its judgment dated 06.09.2022. Since the petitioners were not party to the proceedings initiated by the respondent no.1 before the Tribunal, the aspect that the proceedings for grant of succession certificate were pending could not be brought before the Tribunal.

Issue notice to the respondents returnable in four weeks.
