List the matter on 09.02.2023 for further consideration as Mr. Patil, learned AGP for the respondents/State, by inviting my attention to the judgment of the Hon'ble Apex Court in State of Uttarakhand Vs. Kumaon Stone Crusher, (2018) 14 SCC 537 para 215.1(a) submits, that merely because the stones are crushed into stone grits, stone chips and stone dust, the same does not result into a new commodity and the crushed materials continue to be stone and also on the definition of minor minerals, as occurring in Section 3(e) of the Mines and Minerals (Development and Regulation) Act 1957.
