1 Heard learned counsel Mr.Pendse for the applicant, learned appointed counsel for respondent no.2 and the learned APP.
2 On perusal of the impugned judgment and the notes of evidence, when I have noticed that the Record and Proceedings and paper book is received, I deem it appropriate to list the Appeal itself for final hearing, as the applicant has been incarcerated for more than four years four months.

Mr.Pendse would submit that if the Appeal is ready for hearing, they would make an attempt to argue the Appeal finally, or if the Appeal could not be heard on the given date, then he would renew his request for grant of relief in the Interim Application.
3 Registry is directed to list the Appeal for final hearing in the week commencing from 3/7/2023, preferably by listing it First, on the weekly hearing board.
