2. The contention is that respondent Nos.1 and 2 in defiance of the directions given in the judgment and order dated 28.4.2022 are not paying amount of ₹75,000/- per month as adhoc payment to the petitioners since last several months and the respondents have paid amount of ₹75,000/- to each of the petitioners only for the months of April 2022 and May 2022 and thereafter no payment whatsoever has cp264.2022.odt
been made to the petitioners.
3. If the contention of the petitioners is true, the respondents would be answerable to this Court for committing contempt of this Court, however, before we assume that there is a willful disobedience on the part of respondent Nos.1 and 2, we would like to give them an opportunity to make compliance with the said directions and ensure continued compliance with the same till final disposal of the petition. Hence, issue notice before admission to respondents to explain as to why contempt proceedings be not initiated against them. Meanwhile, the respondents are at liberty to ensure compliance with the aforestated directions by paying the arrears and continue to make the payment of ₹75,000/- per month to each of the petitioners till final disposal.
4. Considering the impending diwali festival it would be appropriate for the State of Maharashtra to make immediate payment of part of the amount which is due and payable to each of the petitioners in terms of the order dated 28.4.2022 and accordingly we direct respondent Nos.1 and 2 to take immediate steps for releasing arrears of the payment due in terms of the order dated 28.4.2022 for the period between June 2022 to October 2022. We further direct respondent Nos.1 and 2 to release the payment of arrears latest by 20.10.2022, failing which this Court shall be constrained to draw appropriate inferences and proceed cp264.2022.odt
further accordingly in the matter, which may include taking of coercive steps against respondent Nos.1 and 2.
