. Heard the learned counsel for the applicant.

2. The applicant was convicted by the learned JMFC, Court-6, Thane for the offence punishable under Section 138 of the Negotiable Instrument Act, 1881 and sentenced to suffer imprisonment for three months and pay fine of Rs.1,90,000/-. The applicant challenged the said order in Criminal Appeal No. 83 of 2017 before the Court of Session, Thane. By the impugned judgment and order dated 22nd November, 2021, the learned Additional Session Judge dismissed the appeal.

3. Being aggrieved, the applicant has invoked the revisional bdp

jurisdiction of this Court.

4. The applicant was on bail during the pendency of the trial and appeal. In a sense, the sentence is short one.

5. Learned counsel for the applicant submits that the applicant would deposit the entire amount of compensation as awarded by the learned Magistrate.

6. In view of aforesaid submission, by way of ad-interim relief, the substantive sentence stands suspended on the condition of the applicant depositing the entire amount of compensation as ordered to be paid by the learned Magistrate within a period of two weeks.

7. In the meanwhile, the applicant be released on bail on furnishing a P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount to the satisfaction of learned Magistrate.

8. Issue notice to the respondents, returnable on 27th June, 2022.

9. Learned APP waive notice for respondent no.2-State.

10. In addition to notice through Court, the applicant is at liberty to serve respondent no. 1 by private service and file affidavit of service.
