After having gone through the impugned judgment, I am of the view that the judgment needs a relook in view of the law laid down in Magma General Insurance Co. Ltd vs Nanu Ram Alias Chuhru Ram , reported in (2018) 18 SCC 130 and Sarla Verma and Ors. .vs. Delhi Transport Corporation and anr. Reported in (2009) 6 SCC 121.
