This is an application for condonation of delay for filing the appeal challenging the judgment and order passed by the Member, Railway Claims Tribunal in O.A. No.116/2013.

2. Heard Shri Joshi, learned counsel for the applicant and Shri Lambat, learned counsel for the non- applicant. The delay is of 45 days. The application is on affidavit. As on today, no reply is filed on behalf of the non- applicant. However, Shri Lambat, learned counsel orally opposed the application.

3. After hearing the learned counsels and after having gone through the contents of the application, I am of the view that the applicant has satisfactorily explained the delay. Hence, I pass the following order :

i. The application is allowed.

ii. Delay of 45 days in filing the appeal stands condoned.

iii. Application is disposed of.

iv. Office is directed to register the appeal.
