By this appeal, the appellant (original non- applicant in Motor Accident Claim Petition No.17/2009) questions the correctness or otherwise of the judgment and award passed by the learned Chairman of Motor Accident Claims Tribunal, Gadchiroli.

2. This appeal was admitted on 09/08/2011. While admitting the appeal statement of the appellant was recorded that half of the amount under award shall be deposited in this Court within a period of ten weeks. The statement of the Advocate was accepted. Inspite of the statement no amount was deposited.

3. Advocate for the original claimants also filed their vakaltnama. Paper book was also prepared.

4. Yesterday, when the hearing of this appeal commenced certain difficulties were expressed by the

learned Advocates for both the parties and therefore, matter was adjourned today.

5. Today when the matter was called, the learned Advocate for the original claimants / present respondents chose not to remain present before the Court.

6. The appellant is represented by his Advocate Mr. N.R. Bhishikar. On instructions from the appellant he makes a solemn statement before the Court that in the year 2018 itself, the appellant and the respondents herein have amicably settled their dispute out of Court. In view of that, learned Advocate Mr. Bhishikar submitted that he has instructions from the appellant to withdraw the present appeal. His statement is accepted. The appeal is disposed of as withdrawn.
