1. Learned counsel for the appellant on instructions seeks

permission to withdraw the application and Criminal Appeal No.

592/2021. He has tendered across the bar a copy of order passed by

this Court (Coram:- Nitin Jamdar & G.A. Sanap, JJ.) dated 21 st

September, 2021 and submits that the very same appellant has fled

Criminal Appeal No. 646/2021, and in the said appeal Interim

Application No. 1967/2021 was fled and this Court has enlarged

the appellant on bail. He submits that since the present appellant

has already fled Criminal Appeal No. 646/2021 challenging the

judgment and order dated 28th May, 2021, whereby the appellant is

convicted, this Court may permit the appellant to withdraw the

Criminal Appeal No. 592/2021.

2. Before we proceed to consider the prayer of the

appellant, we wish to see the record of Criminal Appeal No.

646/2021.

3. Registry to place the record of Criminal Appeal No.

646/2021 (Sunil Tukaram Mane Vs. The State of Maharshtra) for

perusal of this Court.

4. List on 13th October, 2021.
