Civil Application No.2021 of 2019

1. By the present application, the applicant Reliance General Insurance Co. Ltd. seeks condonation of delay of 72 days in filing the first appeal.

2. Heard learned counsel for the applicant and the respondent. I have perused the said application. Para 3 of the said application contains the following averments.

"That after passing an order the Appellant Company has followed and taken advice of the senior advocates of the Appellant Company and after taking advice upon the above claim petition the petition is assign to the Advocate for the further proceedings. Therefore, he Appellant has filed present a separate civil Application for Condonation of delay."

3. In the wake of the aforesaid statements, since the delay is not intentional and deliberate, but bona fide, I deem it expedient to condone the delay. Resultantly, civil application is allowed in terms of prayer clause 6(a) of the application.

5. Learned counsel for the respondent waives service of notice. The parties are in concurrence to the effect that the appeal involves a short question regarding quantum of compensation, the appeal itself can be worked out, finally.
