2. A perusal of the application for condonation of delay indicates
that a condonation of 63 days of delay is sought in filing appeal against
judgment and decree dated 17th September 2018 passed by Bombay
City Civil Court in Suit No. 4853 of 1995. The reasons for the delay are
sought to be explained in paragraphs no. 4 to 10 of the application.
3. It is observed from the office record that respondent no.1 is duly
served and respondent no.2 has been duly served through private
notice, though notice issued to respondent no. 2 on 25 th August 2021,
is yet to be returned.

4. In this view of the matter, list the matter on 11th October 2021,
when the application will be finally disposed, irrespective of whether
parties or their advocates remain present or not.
