By this application, the applicants transferee pendente lite are asking for leave to prefer second appeal against the judgment passed by the first appellate Court. Admittedly, they were not the party in the proceedings before the Courts below.

This Court as per the order dated 18/10/2019 was pleased to direct to list this application along with Second Appeal No.267/2016.

The learned Advocate for non-applicant No.2 expressed difficulty to argue the matter in view of not keeping good health.

The matter be kept in the week commencing from 18 th October, 2021.
