Hearing was conducted through video conferencing and the learned counsel stated that the audio and video quality was proper.

Heard.

Issue notice to the respondents, on the following substantial question of law, returnable after three weeks.

"Whether the lower Appellate Court was justified in allowing the Appeal filed by the respondent, when this Court had partly allowed the earlier Second Appeal bearing No.218/2017 filed by the present appellant and remanded the matter to the lower Appellate Court, by considering that Kabuliyatnama (Exh.24) does not require the registration?

Civil Appln (S) No. 295/2021 Issue notice to the respondents, returnable after three weeks.

Learned Advocate for the applicant/appellant submits that the appellant has been protected by this Court vide its order dated 20th April,2017.

In that view of the matter, there shall be stay to the judgment and decree dated 26.02.2021 passed by learned Principal District Judge, Nagpur in Regular Civil Appeal No. 388/2013, till further orders.

The order be communicated to the learned counsel either on e-mail address or on whatsApp or by such other mode, as is permissible in law.
