Heard Shri Ghare, learned counsel for the petitioner.

(2) The petitioner is original opponent no.2 in Cooperative Case No.545 of 1990 filed by respondent no.1, whose dispute was partly allowed by the learned Judge of the Cooperative Court thereby directing opponent no.1/Five Star Co- operative Housing Society to pay an amount of Rs.60,601/- to the original disputant. Against that, the original disputant preferred an Appeal No.41 of 2009 before the learned Member of Maharashtra Cooperative Appellate Court. By judgment dated 30.11.2010 the said appeal was allowed and directed original opponent no.1 to execute sale-deed in favour of the original disputant.

(3) Learned counsel for the petitioner submits that the petitioner is in actual possession.

(4) Issue notice to the respondents, returnable after eight weeks.

(5) In the meanwhile, parties are directed to maintain status quo.
