DATE : July 15, 2021

The grievance of the petitioners in this contempt petition was the non-compliance of the order issued in Writ Petition Nos.2004/2002 and 5223/2004 on 15/12/2017. By the said judgment the petitioners were granted 50% wages from the date when they had been put out of service after reaching the age of 58 years till they attained the age of 60 years. The burden to pay 50% wages was distributed equally between the Maharashtra State Mining Corporation and the State Government.

During pendency of the proceedings various payments have been made to the petitioners and finally pursuant to the order dated 17/06/2021 a pursis have been filed on behalf of the respondent No.2 on 13/07/2021 stating therein that further payments have been made.

10-CP-93-20 2/2

In that view of the matter we are satisfied that the order passed in writ petition stands complied with. Needless to state that if according to the petitioners they are entitled for any further amount they are free to pursue such remedy as is available to them in law.

The contempt petition is disposed of.

                                    JUDGE JUDGE
