1. Heard Mr. A.B. Mirza, learned counsel for the petitioners and Mr. D.R. Khapre, learned counsel for the respondents.

2. Mr. Mirza, learned counsel for the petitioners submits that the petitioners are challenging the order dated 26.6.2019 passed by the learned Civil Judge, Junior Division, Telhara below Exh.1 in Misc. Judicial Case No. 316/2017.

3. The respondents herein are the Decree Holders, whereas the present Petitioners are the Judgment Debtors. The learned Civil Judge, Junior Division, Telhara passed a decree for partition and separate possession in Regular Civil Suit No. 21/1989. The proceedings were initiated by filing M.J.C. No. 316/2017 for sending precept under Section 54 of the Code of Civil Procedure. The learned Judge on 26.06.2019 rightly found that precept will have to be sent for partition of immovable property by meets and bounds by the Collector.

4. No exception can be found to the impugned order. The writ petition is rejected. Needless to mention, the interim order dated 22.12.2020, stands vacated.
