1. The learned prosecutor places before us a copy of the death

certificate of the original accused (Venkat Birappa Chopde) dated

01.02.2021 which indicates that the original accused passed away on

27.11.2007. The said death certificate is taken on record and marked as

"X" for identification.

2. This appeal has been preferred by the State for challenging

the judgment and order dated 06.09.2003 delivered by the Additional

Sessions Judge, Udgir in Sessions Case No.173/2001, vide which, the

accused has been acquitted of the charge of having committed an offence

punishable under Section 302 of the Indian Penal Code.

3. In view of the above, this Criminal Appeal stands abated.
