No. 8103/SS/2011 as well as the judgment and order dated 10 th November, 2021 passed by the learned Additional Sessions Judge, City Civil and

1-CRA-20043-2021.doc Sessions Court, Greater Bombay in Criminal Appeal No. 827 of 2014 are challenged. By the impugned judgments, the Applicant has been convicted for the offence punishable under Section 138 of the Negotiable Instrument Act.

4. Mr. Vinod C. Singh, the learned Advocate for the Applicant states that the cheque was for Rs.6,75,000/-. He states that 20% of that amount was already deposited. He states that Applicant is ready and willing to deposit 30% amount within a period of 4 weeks from today and balance 50% within 8 weeks thereafter before the learned Trial Court. The said statements made by Mr. Vinod Singh on behalf of the Applicant are accepted as an undertaking to this Court and on that condition, ad-interim relief in terms of prayer clause (c).
