1. Heard.

2. RULE. Rule made returnable forthwith. Heard finally by

consent of the learned counsel for the parties.

3. The petitioner is claiming his up-gradation to the post of

Sectional Engineer and also grant of first benefit of Assured Career

Progressive Scheme on the ground that he has been honourably

acquitted and also exonerated in the Departmental Enquiry that was

held against him. For asserting his such entitlement, the learned

counsel for the petitioner submits that a representation has been made

by the petitioner to the respondent, but the same is still undecided.

4. We are of the view that the purpose of this petition would

stand served if a direction is issued to the respondent for deciding the

representation of the petitioner, in accordance with law.

The petition is partly allowed. The respondent is directed

to decide the representation, dated 07/11/2019, filed by the petitioner,

in accordance with law, at the earliest and in any case, within four

weeks from the date of this order.

Rule accordingly. No costs.
