The suit for partition was decreed. The defendant no.5 Hargundas s/o Haranand Gurunani preferred the Regular Civil Appeal No.112/2013 whereas the defendant nos.1 and 2 Madhukar s/o Bisram Patle and Vivek s/o Bisram Patle preferred a Regular Civil Appeal No.113/2013. Both the appeals were decided by learned Principal District Judge, Gondia as per the common judgment on 09/08/2017, thereby partly allowing them and decree was modified. The Civil Application for condonation of delay bearing No.288/2018 is filed by defendant nos. 1 and 2 whereas defendant no.5 Hargundas s/o Haranand Gurunani has filed Second Appeal No.97/2018.

On 17/12/2018, it was submitted by the parties that dispute is likely to be settled before the executing Court. Since then, the matter is lingering at the stage of admission.

Today, no one has appeared in both these matters. The matter be kept for dismissal on 15/09/2021.
