PER COURT:-
1. Learned counsel for the applicant, on instructions, seeks
leave to withdraw this application.
2. In terms of the reference answered by the Full Bench in the
case of Maya Sanjay Khandare and Othes v. State of Maharashtra ,
reported in 2021 (1) RCR (Criminal) 450, and also in terms of the
ratio laid down by the Supreme Court in Surendra Nath Mohanty
and another Vs. State of Orissa (1999) 5 SCC 238, it is for the
appellate court, before whom Criminal Appeal No. 51 of 2014
against the judgment and order of conviction is pending, to

consider the fact of the compromise for the purpose of reducing the
sentence.
3. In view of the above, leave granted. The Criminal Application
is disposed off as withdrawn.
