Though all respondents have appeared, they have not filed reply. By the impugned judgment, there are two directions first is to remand the suit for fresh trial. The said order is challenged by way of this appeal. Second is giving a finding in respect of one land bearing Gat No.42. It mean to say, while remanding the suit, the trial Court has kept aside the Gat No. 42. It mean to say, trial Court can conduct the trial in respect of all the lands except Gat No. 42. So far as that order is concerned, there is a Second Appeal bearing No. 143/2021 filed. This Court has also framed two substantial questions on 29/07/2021.

2. Now, the trial Court is proceeding with the matter. The proceedings before the trial Court are stayed, till filing of reply by the respondents.

3. Matter be kept on 15/09/2021.
