                 Judgment, the Appeal is allowed.

2. The impugned Judgment and order delivered by the Additional Sessions Judge, Darwha, District Yavatmal in Sessions Trial No.15/2011 on 28/2/2014 is hereby quashed and set-aside.

3. The Appellant/accused is acquitted of the offence punishable under Sections 302 and 309 of Indian Penal Code.

4. The fine amount, if paid by the Appellant, be refunded to him.

5. The bail bonds of the Appellant stand cancelled.
