PER COURT :-

1. The final hearing of this petition at admission stage

concludes with the learned counsel for the respective sides

concluding their oral submissions.

2. Before we would commence the dictation of the

judgment in this matter, we deem it appropriate to direct the

learned AGP to place before us the entire file pertaining to the

grant of the benefits under the Maharashtra Civil Services

(Pension) Rules, 1982 to the employees of the Maharashtra

Rajya Khadi and Village Industries Board with effect from

2 909-WP.6567-20.odt

01.04.1985 vide the Government Resolution issued by the

Industry, Energy and Labour Department, dated 01.07.1985.

The reason why we wish to have a look at the file is because

the employees of the Maharashtra Rajya Khadi and Village

Industries Board are similarly situated as the employees of the

Maharashtra Pollution Control Board since both the Boards are

identically placed with zero (0) financial aid from the State

Government. We wish to go through the logic behind the State

Government agreeing in 1985 to apply the Maharashtra Civil

Services (Pension) Rules, 1982 to the employees of the Khadi

Board and declining to entertain the request of the Pollution

Control Board made vide a Resolution passed on 28.05.1987

since there was a forceful demand of the employees to be

placed at par with the employees of Maharashtra Khadi Board.

So also, we would expect the learned counsel for the respective

sides to place before us judicial pronouncements, if any.
