              ORAL JUDGMENT (Per R. K. Deshpande, J.)



The challenge in this petition is to the order dated 02-02-2002

passed by the Tahsildar, Achalpur, directing the petitioner to close

down the Cable Network Service for the defects which are pointed

out in the said order. The matter was admitted on 05-03-2002 and

stay was granted in terms of prayer clause (iii) staying the effect and

operation of the said communication. There is no reply filed by the

respondents in response to this petition.

2] The petition was filed in the year 2002 and is coming for

hearing after 15 years. The policy of the Government for Cable

Network Service must have been undergone change and apart from

it, if there are any such defects in rendering services and violation of

any provisions of relevant Act and Rules, it shall be open for the

respondents to take appropriate action by issuing show cause notice

and following the procedure prescribed for that purpose. We,

therefore, allow this petition and set aside the order dated 02-02-2002

impugned in this petition with liberty to the petitioner to take

appropriate steps as are permissible in law. Needless to say that this

decision shall not come in the way of respondents in subsequent

proceedings. No costs.
