IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION
CRIMINAL WRIT PETITION NO.3007 OF 2017
Biltu Domilal Gupta (Through Jail) .... Petitioner
Versus
The State of Maharashtra .... Respondent
Mr. Prosper D'Souza, Appointed Advocate, for the Petitioner. Mrs. G.P. Mulekar, A.P.P., for the Respondent-State.
CORAM : SMT. V.K. TAHILRAMANI & DR. SHALINI PHANSALKAR-JOSHI, J.J.
DATE : 23RD AUGUST, 2017.
ORAL JUDGMENT : [Per Smt. V.K. Tahilramani, J.]
1. Heard both sides.
2. Petitioner preferred an application for furlough on 16 th May
2016. His grievance is that, though he preferred an application for
furlough on 16th May 2016, till today, his application for furlough has
not been decided.
3. It is seen that the Petitioner wanted to spend his period of
furlough in the State of Jharkhand. Hence, on receiving the
application of the Petitioner for furlough, the authority sent the same

to Jharkhand to obtain Police Report. However, no Police Report has
been received from the State of Jharkhand, in spite of seven
reminders.
4. In this view of the matter, as soon as the Police Report is
received, the authority to take a decision in relation to the application
of the Petitioner for furlough within a period of three week therefrom.
Thus, at this stage, we are not inclined to interfere. Writ Petition is
disposed of. Rule is discharged.
