ORAL JUDGMENT :

1. Rule. Rule made returnable forthwith and heard learned

advocate for the applicant finally with consent. Despite service

none appears for the respondent.

2. This Miscellaneous Civil Application has been moved for

transfer of petition bearing P.A.N. 149 of 2014 pending before

{2} mca125-14

Family Court at Pune to a competent court at Ambajogai.

3. Learned advocate for the applicant states that relations

between the parties had been strained and the respondent had

been refusing to take back the applicant for cohabitation. He

further states that the applicant is staying along with her parents

at Ambajogai, which is about 370 kilometers away from Pune

and it is inconvenient for traveling alone. Besides, economic

condition of her parents is not sound and as such, it would be

difficult for her to attend to the court proceedings at Pune which

would cause hardship.

4. In spite of service, no appearance has been caused on

behalf of the respondent giving, to a large extent, tacit

acceptance of the submissions and contentions of the applicant.

5. In view of aforesaid, the Miscellaneous Civil Application

stands allowed. Rule is made absolute in terms of prayer clause

"B". Miscellaneous Civil Application stands disposed of.
