ORAL JUDGMENT (Per B.R. Gavai, J. )
1. Rule. Rule is made returnable forthwith. Heard finally by
consent of the learned counsel appearing for the parties.
2. The facts in the present case are identical with the facts
in Writ Petition No.6116 of 2014 along with Companion matters
decided by this Court on 16.12.2014.
3. The
Division Bench of this Court (comprising of
Smt.Vasanti A. Naik and C.V.Bhadang, JJ), on the basis of statement
made by the learned Additional Government Pleader, on the basis
of communication issued by Shri V.M. Bivalkar, Desk Officer,
Government of Maharashtra, dt.15.12.2014, has held that the
Government Resolution dt.4.9.2014 is prospective in nature and the
same would not affect the petitioners and the State/ National
Awardee Teachers who have been granted benefit of two
advance/additional increments before issuance of Government
Resolution dt.4.9.2014.
4. The Court, on the basis of statement made by learned
Government Pleader, on the instructions of Desk Officer, had
disposed of the petitions by directing the State Government to pay
the monetary benefits flowing from the earlier resolutions to the
petitioners within a period of six weeks from the said date.

5. Ms Ritu Kalia, learned Additional Government Pleader
states that now the Government is proposing to withdraw all the
Government Resolutions issued prior to 4th September, 2014 vide
which the Government had decided to award two
advance/additional increments to the State/National Awardee
teachers.
6. The State Government being a model litigant cannot be
permitted to indulge approbate and reprobate. Having taken a
stand in various petitions that the Government Resolution
dt.4.9.2014 is prospective in nature and the same would not affect
the petitioners and the State/National Awardee teachers, who have
been granted benefit of two advance/additional increments before
issuance of Government Resolution dt.4.9.2014, it now cannot take
a stand contrary to the earlier stand. In any case, the rights of the
petitioners would be governed by the Government Resolutions
which were in force at the time when the right was conferred upon
them under various Government Resolutions awarding them two
advance/ additional increments.
7. In that view of the matter, we are of the considered view
that the petitioners would also be entitled to the same relief as has
been granted to the petitioners in Writ Petition No.6116 of 2014
along with Companion Petitions vide Judgment and Order of this
Court dt.16.12.2014.

8. Rule is, therefore, made absolute in terms of prayer
clause (A) of the Writ Petition. The monetary benefits be paid to the
petitioners within a period of six weeks from today.
No order as to costs.
