ORAL JUDGMENT :

None appeared for the non-applicant on 10-10-2016. The

matter was adjourned. Today again none appeared for the

non-applicant.

Heard Shri M. Yejajul, Advocate for the applicant/wife.

2. Rule. Rule made returnable forthwith.

3. The transfer of proceedings filed by the non-applicant in

the Court at Daryapur are sought on the ground that the applicant is

having 1½ year old daughter and it is extremely difficult and

inconvenient for her to attend the proceedings. The applicant is

residing at Nagpur and has prayed for transfer of the proceedings at

Nagpur.

4. Accepting the submissions made on behalf of the

applicant/wife which are not controverted, the prayer of the applicant

is granted. The proceedings of Hindu Marriage Petition No.20/2015

filed by the non-applicant and pending before the Court at Daryapur

are transferred to the Family Court, Nagpur.

The miscellaneous civil application is allowed. In the

circumstances, the parties to bear their own costs.
