     ORAL JUDGMENT :





     1.       Rule.      Rule made returnable forthwith.           Heard learned

counsel for parties finally, by consent.

2. After hearing, learned counsel resile to a situation

whereunder position can be salvaged for both the parties.

3. According to learned counsel common evidence being not

possible, the parties gracefully agree to lead evidence in respect of

respective petitions filed against each another.

4. Learned counsel for respondent at this juncture states that

the petition filed by present petitioner is first in point of time, she

should lead evidence first. Learned counsel for petitioner has no

particular resistance to the same.

5. Rule made absolute in aforesaid terms. Writ petition stands

disposed of, accordingly.
