The Court made the following:

JUDGMENT:

1. As per the Registry endorsement, the notice sent the appellant No.2

was returned with an endorsement "un-served" and the notices sent to the

appellant Nos.3 to 5 were returned with an endorsement "no such person in

this door number". Therefore, „service held sufficient‟.

2. Today when the matter is taken up for hearing, none appeared for the

appellants. Learned counsel for the respondents is present. It seems that

the appellants are not inclined to prosecute the appeal.

3. Therefore, the Appeal Suit is dismissed for default. There shall be no

order as to costs.

As a sequel, miscellaneous petitions, if any pending, shall stand closed.
