This petition filed by the petitioners under Section 397(1) of Cr.P.C. seeking to suspend the sentence of imprisonment, which is imposed in C.C.No.432 of 2018 dated 02.01.2023 on the file of I Additional Judicial Magistrate of First Class, Ananthapuramu as confirmed in the judgment dated 31.07.2024 in Crl.A.No.7 of 2023 by the learned Principal District & Sessions Judge, Ananthapuramu, pending disposal of the Criminal revision case.

Learned counsel for the petitioners submits that the petitioners are found guilty for the offences under Section 498-A of IPC and Section 4 of Dowry Prohibition Act, wherein the petitioner were sentenced to undergo simple imprisonment for three months and to pay fine of Rs.1,500/- each for the offence U/Sec.498-A of IPC and further they sentenced to undergo simple imprisonment for three months and to pay fine of Rs.500/- each for the offence punishable U/Sec.3 of Dowry Prohibition Act vide judgment passed in C.C.No.432 of 2018 on the file of I

The appeal preferred by the petitioners is dismissed confirming the conviction and sentence passed against them, vide judgment in Crl.A.No.7 of 2023 by the learned Principal District & Sessions Judge, Ananthapuramu.

Heard. Perused the material record.

Learned counsel for the petitioners submits that the petitioners have merits in the revision, accordingly prays to suspend the sentence passed against them and the petitioners are sole breadwinner of their family.

The learned Assistant Public Prosecutor would submit to pass appropriate orders.

Considering the submissions made and on perusal the material on record, this revision requires time for disposal. Hence, this petition is allowed with the following terms:

The petitioner is directed to surrender before the I Additional Judicial Magistrate of I Class, Ananthapuramu, and on such surrender the petitioner shall be enlarged on bail on his executing a personal bond for Rs.10,000/- (Rupees ten thousand only) each with two
