The Court made the following:

JUDGMENT:

(per Ravi Nath Tilhari, J)

By order dated 11.09.2009 in O.S.No.19 of 2008 on the file of VI Additional

District Judge at Visakhapatnam, the plaint was returned. This appeal was wa filed

challenging the said order.

2. Sri G.Rama Gopal, learned counsel for the appellant appearing through

virtual mode submits that inspite of time having been granted on various dates, dat

previously, the appellant iss not providing instructions.

3. We are of the view that the order of return of plaint was passed, way back

in the year 2009, there is no interim order in this appeal. The appellant might

have instituted the suit before the appropriate forum and be not interested in

pursuing this appeal.

4. The Civil Miscellaneous Appeal is dismissed.

No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, shall also stand

closed.
