The Court made the following

JUDGMENT :

- (Per the Hon'ble Sri Justice K.Sreenivasa Reddy)

Basing on the written instructions furnished by the Jailor, Central

Prison, Visakhapatnam, Sri.K.Anand Kumar, learned Assistant Public

Prosecutor, submitted that the appellant (convict) has complained of

severe breathlessness. Immediately, the Jail Authorities shifted him to

King George Hospital, Visakhapatnam. On examination by the Doctors, they declared that the appellant was brought dead on

15.02.2023 at about 7.10 A.M.

2. Learned counsel for the appellant also confirms the factum of

death of the appellant.

3. In view of the death of the sole appellant, the Criminal Appeal is

dismissed as abated.
