The Court made the following:

The petitioners, who are in-service candidates, and had applied for admission to P.G Medical Courses for the academic year 2024-25, have approached this Court with the complaint that the 4th respondent, who was out of the zone of consideration, as he had not completed his required medical service, by 16.04.2024, which was the cutoff date, has now entered the fray on account of a judgment of this Court permitting him to participate in the counseling process, despite the fact that he had not completed required medical service by the cutoff date of 16.04.2024.

The petitioners contend that similar orders, as passed in favor of the 4th respondent, had been given for the academic year 2023-2024.However, all the said orders were qualified with the direction that persons who had not completed their required service but were being permitted to participate in counseling by virtue of the orders of this Court, would be considered only after all the persons, who were eligible by the cutoff date, are considered.

The 4th respondent had approached this Court contending that he was completing his required service by 26.04.2024 and the fixation of the cutoff date of 16.04.2024 was arbitrary. In that view of the matter, this Court had permitted the 4th respondent to participate in the counseling process without being asked to show that he had completed his required medical service by 16.04.2024.

This Court, in similar situations in W.P.No.26833 of 2023 and W.P.No.25781 and 25843 of 2023 as well as the order in the review application in I.A.No.2 of 2023 and I.A.No.3 of 2023 in W.P.No.20919 of 2023, had directed that consideration of candidates who were brought within counseling process, on account of extension of the cutoff date, by virtue of the orders of this Court, would be considered only after the candidates who were eligible as per the original cutoff date are considered.

In such circumstances, there shall be an interim direction directing the convener to consider the cases of the petitioners herein and all such other persons who were eligible, as in service candidates, on or before 16.04.2024 before the 4th respondent is considered.
