    JUDGMENT:

The Second appeal is filed aggrieved by the Decree and

Judgment dated 21.08.2007 in A.S.No.81 of 2005 on the file of the

Court of VII Additional District and Sessions Judge, (FTC) Vijayawada.

2. Today, when the matter is taken up, learned counsel for the

appellant submits that the matter is settled out of Court and requests to

withdraw the appeal.

3. Permission is accorded.

4. Recording the submissions made and without going into the correctness

of the submissions of learned counsel for the appellant, this second

appeal is dismissed as withdrawn. No costs.

5. Miscellaneous petitions pending, if any, in this appeal shall stand

closed.
