THE COURT MADE THE FOLLOWING JUDGMENT:

The Second Appeal is preferred by the appellant against the

judgment and decree dated 28.04.1997 passed in A.S.No.21 of 1993

and cross objections in A.S.No.21 of 1993 on the file of the IV Additional

District Judge, East Godavari District, Kakinada.

2. On reporting no instructions by learned counsel for the appellants,

this Court ordered notice to the appellant Nos.1 and 2, but the notices

sent were returned as they died. It seems that the legal representatives of deceased appellant Nos.1 and 2 have not shown interest to pursue

the appeal. Hence, this Court has no other alternative but to dismiss the

appeal.

3. Accordingly, the Second Appeal is dismissed for default. There

shall be no order as to costs.

Miscellaneous petitions pending, if any, in this appeal shall stand

closed.
