THE COURT MADE THE FOLLOWING JUDGMENT:
The Second Appeal is preferred by the appellant against the
judgment and decree dated 06.09.2002, passed in A.S.No.170 of 1999
on the file of the VI Additional District Judge, (Fast Track Court),
Chittoor, confirming the judgment and decree dated 27.07.1998 passed
in O.S.No.425 of 1997 on the file of the Principal Junior Civil Judge,
Tirupathi.
2. On being represented by learned counsel for the appellant, this
court ordered notice to the appellant, but the same was returned
un-served with an endorsement 'No Such Person' and the matter was
directed to be listed under the caption 'For Dismissal'.
3. Today, when the matter is taken up for hearing, none appeared for
the appellant. It seems that the appellant has no interest to prosecute
the matter.
4. Accordingly, the Second Appeal is dismissed for default. There
shall be no order as to costs.
Miscellaneous petitions pending, if any, in this appeal shall stand
closed.
