The Court made the following order:

This Writ Petition under Article 226 of the Constitution of India is filed for the following relief:

"to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not following the provisions of the Criminal Procedure Code Section 154 3 of Cr P C or

Section 173 of BNSS Act and not initiating to register the F I R basing on the complaints dated 17 7 2024 vide Petition No 178/2024 dated 17 7 2024 and dated 6 9 2024 against the Respondent Nos 5 and 7 who connived with each other and created forged document to grab my land and threatened to kill me and my family members is illegal arbitrary unconstitutional and violation of Articles 14 15 21 of Constitution of India and also violation of Principles of Natural Justice and consequently direct the Respondents to follow the provisions of the Criminal Procedure Code Section 154 3 of Cr P C or Section 173 of BNSS Act and register the F I R basing on the complaint dated 17 7 2024 and 6 9 2024 against the Respondent Nos 5 and 7 and pass such..."

2. Heard learned counsel for the petitioner and learned

Assistant Government Pleader appearing for the State.

3. Learned Assistant Government Pleader on instructions

would submit that the petitioner presented a report before

respondent No.3/Police on 17.07.2024. The Police conducted

preliminary enquiry which reveals that it is a civil dispute and the

police will never interfere into the civil disputes.

4. Recording the submission of learned Assistant Government

Pleader, the Writ Petition is closed at the stage of admission

itself. However, the petitioner is at liberty to file a private

complaint before the jurisdictional Magistrate as per the

provisions of BNSS, 2023 and also in the light of judgment of the

Hon'ble Apex Court in M.Subramaniam Vs. S.Janaki and

another1. No order as to costs.

As a sequel thereto, the interlocutory applications, if any,

pending in this Writ Petition shall stand closed.
