no appearance.

Heard the learned counsel for the petitioner/appellant.

For the reasons stated in the affidavit, delay of 36 days in filing the present appeal is condoned.

Accordingly, the petition is allowed.

This petition is filed to suspend the decree and judgment dated 13.10.2022 passed in MVOP.No.253 of 2016 on the file of the Court of Motor Accidents Claims Tribunal-cum-V Additional District Judge, Tirupati, pending the disposal of the present appeal.

The learned counsel for the petitioner submitted that the tribunal has not properly appreciated the evidence regarding the age of the diseased and also the occupation and income of the diseased and thereby granted higher amount of compensation.

the respondents No.1 to 3 in I.A.No.1 of 2024, there 27.06.2024 has been no representation.

The learned counsel for the petitioner/appellant submitted that E.P. was filed by the claimants subsequent to filing of the appeal.

In the light of the contentions stated in the affidavit and the submissions noted above, since the hearing of the appeal would take further time, interim stay is granted on the condition that the petitioner/appellant shall deposit 75% of the amount as per the decree within eight (08) weeks from the date of this Order, failing which the interim stay granted gets vacated without any further orders.
