The Court made the following ORDER:

1) None appeared for the Petitioner/Accused, though the petition is

listed under the caption 'for dismissal'.

2) Heard Sri. V. Farook, Assistant Government Pleader assisting

the Public Prosecutor for the State.

3) This is an application filed under Section 438 of Code of

Criminal Procedure, 1973 ['Cr.P.C.'], to enlarge the Petitioner/Accused

on anticipatory bail.

4) As per the judgment of the hon'ble Supreme Court in Satendra

Kumar Antil Vs. Central Bureau of Investigation and Anr.1,

anticipatory bail application has to be disposed of within a period of six

[06] weeks as far as possible. Paragraph No. (k) of the judgment reads

as under:

"(k) Bail applications ought to be disposed of within a period of two weeks except if the provisions mandate otherwise, with the exception being an intervening application. Applications for anticipatory bail are expected to be disposed of within a period of six weeks with the exception of any intervening application."

5) This application is filed in the month of December, 2023. Yet, the

Petitioner is not coming forward to prosecute the petition. In that view

of the matter, the Criminal Petition is dismissed for non-prosecution.

6) As a sequel, pending applications, if any, shall stand closed.
